Terms of service

The rules for using SWFL Leak Directory, in plain words. Last reviewed October 24, 2026.

1. Acceptance

SWFL Leak Directory (the directory, the site, we, us) is run by Daniel Argota from Punta Gorda, Florida. By using the site you accept these terms. If you use it for an employer or a business, you accept them for that business too. If you do not accept them, do not use the site.

We may change these terms by posting a new version here with a new date. Using the site after that date means you accept the new version.

2. What the site is

The directory is a free list of local businesses in Southwest Florida. Each listing is compiled from public business information and links to the business’s own website. A listing is not a recommendation, a rating or advice, and no business has paid to appear.

The site also describes marketing services we offer to businesses. Those services are agreed separately, in writing, and are not governed by these terms.

We may change, suspend or close any part of the site, and refuse, move or remove any listing or submission, at any time and without notice. We are not liable to you or to anyone else for doing so.

3. Accuracy and no advice

Details change. Phone numbers, hours, addresses and licence numbers are shown as the business published them. Confirm them with the business before you rely on them. A licence number shown on a listing has not been checked against the state record unless the listing says so. Nothing on the site is legal, medical, financial or professional advice, and nothing on it is a promise about the quality of a business’s work.

4. Submissions

The add form takes a new business, a claim from the business itself, or a correction. When you send it you confirm that:

  • you are allowed to speak for the business, or you are reporting a plain factual error;
  • the details are true and current, as far as you know;
  • you are an adult and may enter a binding agreement;
  • you have the right to give us anything you send, including any description or licence number.

We decide what is published. We may edit a submission for length, format or accuracy, refuse it, or remove a listing later. We reply once, to the email address you gave. There are no visitor accounts on the site.

5. What you may not do

You agree not to use the site to:

  • submit false details, claim a listing for a business you do not speak for, or impersonate anyone;
  • send anything unlawful, defamatory, obscene, threatening or infringing;
  • send advertising, chain messages or anything that is not a listing request;
  • send viruses or code that could damage any system;
  • scrape, copy or republish the directory as a whole or in large part, or place an unreasonable load on our servers;
  • work around any security or rate limit on the site;
  • break any law.

We may refuse further submissions from anyone who does these things, and we may keep and disclose submissions as the law requires or to protect the site and its visitors.

6. Your content and our licence to it

You keep ownership of what you send us. You grant us a worldwide, royalty free, perpetual licence to publish, store, copy, edit, translate and display it on the directory and in search results, feeds and copies of the directory, in any medium. That licence lets the listing stay published and lets search engines index it. If you ask us to remove something, we remove it from the site, but copies may remain in search engine caches we do not control.

7. Our content

The name SWFL Leak Directory, the pelican mark, the page design, the text we wrote and the arrangement and selection of listings belong to us. You may link to any page, quote short passages with a link, and use the information on a listing to contact that business. You may not copy the directory, or a substantial part of it, for another directory, a mailing list or a data product without our written permission. Business names, logos and facts belong to the businesses themselves.

The site links to the websites of listed businesses and to map and licence lookups. We do not control those sites, we do not endorse them, and we are not responsible for what they contain or do. Your use of them is at your own risk and under their terms.

9. Dealings with listed businesses

Any contact, quote, contract or payment between you and a business you found on the directory is between you and that business. We are not a party to it, we do not vouch for the business, and we are not liable for anything that comes of it.

10. Photographs

Photographs on the site are used under the licences named in the photo credits section of the how we check page. They may not be copied from this site without the permission that each licence requires.

11. Disclaimer of warranties

The site and everything on it are provided as is and as available, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title or non-infringement. We do not promise that the site will be uninterrupted, timely, secure or free of errors, that any listing is accurate or current, or that any business will meet your expectations. Nothing you read or hear from us creates a warranty.

12. Limitation of liability

To the fullest extent the law allows, we are not liable to you for any indirect, incidental, special, consequential or exemplary damages, or for any loss of profit, goodwill, data or business, arising from the site, from any listing, from any business you found through it, or from any inability to use it, even if we were told such damages were possible. If a court finds us liable despite this section, our total liability to you for all claims together is limited to one hundred US dollars.

Some states do not allow some of these exclusions, so some of them may not apply to you. In those states our liability is limited as far as the law permits.

13. Indemnity

You agree to defend and hold us harmless from any claim, loss or expense, including reasonable attorney fees, that arises from anything you submit, from your use of the site, from your breach of these terms, or from your violation of anyone else’s rights.

We respect other people’s work. If you believe something on the site infringes your copyright or other intellectual property, send us:

  • your physical or electronic signature, or that of someone authorised to act for you;
  • a description of the work you say is infringed;
  • the address of the page on this site where it appears;
  • your postal address, phone number and email address;
  • a statement that you believe in good faith the use is not authorised by the owner, its agent or the law;
  • a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorised to act for the owner.

Send it to Daniel Argota, Punta Gorda, Florida, by email to Daniel@argota.co with the subject line “Copyright notice”. We may remove material on receipt of a complete notice and may stop accepting submissions from repeat infringers.

15. General

  • Entire agreement. These terms and the privacy policy are the whole agreement between you and us about the site.
  • Governing law and venue. Florida law governs these terms, without regard to its conflict of law rules. Any dispute about the site is brought only in the state or federal courts for Charlotte County, Florida, and you consent to their jurisdiction.
  • Time limit. Any claim arising from the site or these terms must be filed within one year of the event that gave rise to it, or it is barred.
  • Severability and waiver. If a court finds any part of these terms unenforceable, the rest stays in force. If we do not enforce a term once, we may still enforce it later.
  • No third parties. These terms give rights to you and to us only.
  • Notices. We may give you notice by email to the address you gave or by posting on the site. Section titles are for convenience and have no legal effect.

16. Contact
